What is different about Bihar

The forum

There is no NCLT bench in Bihar. Companies registered in the state are heard on insolvency at the NCLT Kolkata bench, which also covers West Bengal, Jharkhand and the Andaman and Nicobar Islands. Appeals go to the Patna High Court, and commercial suits are filed at the commercial court for the relevant district. A creditor planning a section 9 petition against a Bihar company should budget for it to be run out of Kolkata.

A supplier registered on Udyam as a micro or small enterprise has a route the rest of the market does not: section 15 of the MSMED Act makes payment due in 45 days, and sections 16 to 18 let the supplier refer the unpaid invoice to a Micro and Small Enterprises Facilitation Council instead of filing suit. Interest runs at three times the RBI bank rate, compounded monthly, and a buyer who wants to challenge the award must first deposit 75 per cent of it. Traders are excluded; the registration must pre-date the supply. Bihar runs a single state-level council seated with the Department of Industries at Patna, so references from anywhere in the state are made there.

What we see in Bihar

Bihar is a distribution state before it is a manufacturing one, so most claims run against stockists and distributors rather than against factories. Two things follow. The debtor's assets are stock and receivables rather than plant, which changes what enforcement can realistically reach; and the supplier usually has only one distributor for the state, which makes them reluctant to escalate until the position is already bad.
