1. Who we are
1.1 Kenstone Capital is a brand operated by Kenstone Capital Debt Consulting Private Limited, a company incorporated in India under the Companies Act, 2013, with its registered office at Lakshmi Nilaya, 1st Main, 2nd Cross, Ranganatha Extension, Gopala, Shivamogga, Karnataka 577205 and its corporate office at Sabari Complex, Field Marshal Cariappa Road, Shanthala Nagar, Ashok Nagar, Bengaluru, Karnataka 560025.
1.2 We provide business-to-business receivables management, commercial debt-collection consulting and legal-recovery coordination in India, and, for banks and financial institutions that have empanelled us, support with enforcement of security interest under the SARFAESI Act. We do not provide consumer debt collection, work on individuals' credit profiles, lending, bank-auction services or property brokerage, and nothing on this website offers those services.
2. Who may use this website
2.1 This website is intended for businesses, their officers and employees, professional advisers, referral partners and business creditors located in or outside India who are considering or using our services, and for debtor businesses seeking information about how we work.
2.2 If you submit information on behalf of an organisation, you confirm that you are authorised to do so and that the organisation will be bound by any acknowledgement you give on its behalf.
2.3 This website is not directed at individuals seeking help with personal loans, credit cards or their personal credit profiles. Individuals with those needs are served by our group company, Kenstone Credit, at kenstonecredit.com, a separate entity with its own terms and privacy policy.
3. Information, not advice
3.1 The content of this website — including guides, calculators, case descriptions and answers to common questions — is general information about receivables practice and Indian law as we understand it at the date shown on each page. It is not legal, financial, tax or accounting advice and does not create an adviser–client relationship.
3.2 Statutes, thresholds, limitation periods and procedures change. Confirm the current position with a qualified professional before acting. Where a page states a figure (for example the minimum default for an application under section 9 of the Insolvency and Bankruptcy Code, 2016), it states the position as generally understood on the page's date.
3.3 Kenstone is not a law firm, and its employees do not provide legal advice or representation. Where legal proceedings are appropriate, advice and representation are provided by independent advocates engaged for that purpose — ordinarily our empanelled law firm, TrueNorth Legal Partners, or an advocate of the client's own choice.
4. Submitting a form does not engage us
4.1 Sending an enquiry, calling us, messaging us on WhatsApp or using the DSO calculator does not appoint Kenstone to act for you, does not create any obligation on us to accept a matter, and does not start any limitation clock running in your favour.
4.2 We act only under a signed engagement (a Master Services Agreement and Statement of Work, or an engagement letter that incorporates our B2B Debt Collection Service Terms). Until then, do not send us debtor documents, ledgers, contracts or any other confidential material; use the secure upload route we provide after a practitioner has spoken with you.
4.3 A practitioner reads every enquiry and aims to reply within one working day (Monday to Saturday, 9 AM to 6 PM IST, excluding public holidays in Karnataka). This is a service aim, not a guarantee.
5. No guarantee of recovery
Nothing on this website promises, predicts or implies that any sum will be recovered, in any amount, within any time, or by any method. Recovery depends on the documents, the limitation position, disputes, the debtor's solvency and conduct, and the courts and tribunals. See the Recovery and Legal Disclaimer.
6. Permitted use
You may view, download and print pages for your own business use, with all notices intact. You may link to our pages provided the link does not suggest endorsement or partnership.
7. Prohibited use
You must not: (a) use the website or any information on it to contact, pressure or locate any debtor business or individual; (b) copy, scrape or republish our content or data at scale; (c) submit false, misleading or third-party information without authority; (d) attempt to gain unauthorised access to the website, its forms or connected systems, or test their security other than under our Responsible Security Disclosure Policy; (e) introduce malicious code; (f) use the website for any unlawful purpose or in breach of the Information Technology Act, 2000; (g) impersonate Kenstone, its staff or its clients.
8. Accounts
The website does not offer user accounts. If a client portal is introduced, separate access terms will apply and will be provided at registration.
9. Information you submit
9.1 Information you submit through a form, by email or by message is handled under our Privacy Policy. You are responsible for its accuracy.
9.2 By submitting information about a debtor business or its representatives, you confirm that you are entitled to share it with us for the purpose of assessing a possible engagement, and that you have not included personal data of individuals unconnected to the commercial relationship.
9.3 We may keep enquiry records for the period stated in the Privacy Policy, and we may decline any enquiry without giving reasons.
10. Intellectual property
10.1 The Kenstone Capital name, logo, the S-curve device, the tagline "Unlock Cashflow, Unlock Opportunities." and all website content, code and design are owned by Kenstone Capital Debt Consulting Private Limited or its licensors and are protected by Indian and international law.
10.2 Nothing on the website grants you any licence except as stated in clause 6. Statutory materials quoted on the website (Acts, rules, notifications) are reproduced from official sources and remain government works.
11. Third-party content and links
Links to statutes, government portals, court websites, group companies or other third parties are provided for convenience. We do not control those sites and are not responsible for their content or their privacy practices. A link is not an endorsement, and no third-party name or mark on this website implies that the third party endorses Kenstone.
12. Case studies, testimonials and figures
12.1 Any case study we publish is drawn from engagement records, is published with the client's written consent, names the practitioner who ran it, and withholds the debtor's identity. Figures are stated only where the record supports them.
12.2 Any client quotation we publish is verbatim, approved in writing and attributed as the client has agreed. We do not buy, write or edit reviews, and we do not use review or rating mark-up for our own business.
12.3 Results in any case study or quotation are specific to that engagement and its facts. They do not indicate, and must not be read as indicating, what any other matter will recover or how long it will take.
13. Availability and security of the website
13.1 We aim to keep the website available but do not guarantee uninterrupted access. We may change, suspend or withdraw any part of it without notice.
13.2 We use reasonable technical measures to protect the website, but transmission over the internet is not completely secure. Do not submit confidential portfolio data through public forms; use the secure route we provide after engagement.
14. Liability
14.1 Nothing in these terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be excluded under Indian law.
14.2 Subject to clause 14.1, and because the website is informational and free to use, Kenstone is not liable for any loss arising from reliance on website content, from website unavailability, or from any act of a third party, and in any event is not liable for indirect, consequential or economic loss, loss of profit or loss of business arising from use of the website.
14.3 Liability for paid services is governed by the signed engagement and the B2B Debt Collection Service Terms, not by this clause.
15. Indemnity
If you use the website in breach of clause 7 or 9, or submit information you are not entitled to submit, you agree to indemnify Kenstone against losses, claims and reasonable costs arising from that breach.
16. Governing law and disputes
16.1 These terms are governed by the laws of India.
16.2 Any dispute about the website or these terms is subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka. Before starting proceedings, please write to us under the Grievance Redressal Policy; most issues are resolved that way.
16.3 This clause governs only the relationship between you and Kenstone as a website user. It does not bind any debtor business to arbitration or to any forum, and it does not alter the terms of any contract between a client and its debtor.
17. Changes to these terms
We may update these terms. The version number and dates at the top change when we do, and earlier versions are available on request at the contact address below. Continued use of the website after a change means the current version applies to that use; it does not change any signed engagement.
