When can a lender invoke Section 13(4)?
Section 13(4) can be invoked after the 60-day Section 13(2) demand notice period has lapsed without full repayment or an acceptable resolution from the borrower. The lender must also have duly considered any borrower representation made under Section 13(3A) before proceeding to possession.
What types of assets can be possessed under Section 13(4)?
Section 13(4) applies to all secured assets covered under the registered security interest including immovable properties such as land and buildings, movable assets such as machinery and vehicles, and financial assets such as receivables and book debts.
Can a borrower challenge a Section 13(4) possession action?
Yes. A borrower can file an appeal before the Debt Recovery Tribunal (DRT) under Section 17 of the SARFAESI Act within 45 days of the possession action.
