What is physical possession under SARFAESI and when is it required?
Physical possession is the actual, on-ground takeover of a secured property from a defaulting borrower as distinct from symbolic possession. It is required when the borrower refuses to vacate voluntarily after a Section 13(4) possession notice, or when a Section 14 CMM or DM order has been obtained and the property must be physically secured by the lender’s authorised team.
Can a borrower legally resist or stop physical possession?
A borrower can file an appeal under Section 17 of the SARFAESI Act before the Debt Recovery Tribunal within 45 days of the possession action. However, resisting physical possession without a valid DRT stay order is illegal.
